Attorney Kristen Hwang of One Law Partners, LLC has published a revised and expanded edition of National R&D Project Litigation.

Recognized as one of Korea’s leading legal practitioners in the field of government-funded projects, including grants and subsidies, Attorney Kristen Hwang first published National R&D Project Litigation in August 2025 based on her extensive practical experience.

National R&D projects constitute a highly specialized area of administrative law, yet practitioners have traditionally had limited access to dedicated practical or academic resources and have often relied primarily on manuals issued by the Ministry of Science and ICT.

Against this backdrop, National R&D Project Litigation received significant attention and favorable responses from R&D specialized institutions and participants in government-funded projects following its initial publication.

Attorney Hwang explained, “While handling matters relating to national R&D projects after the publication of the first edition, I encountered newly emerging issues as well as matters that practitioners often overlook. I decided to write this revised edition in order to examine and share those issues together.”

This revised and expanded edition provides a more in-depth discussion of issues including defects in the project selection evaluation process, rights relating to the outcomes of national R&D projects (including VAT issues arising from government ownership and the government’s right of implementation), technology royalties, and administrative sanctions and discretion.

Since first publishing National R&D Project Litigation in August 2025, Attorney Kristen Hwang has handled a wide range of advisory and litigation matters based on her research and practical experience regarding legal issues arising from national research and development projects.

Following the publication of the first edition, clients showed significant interest in legal disputes and rights issues relating to national R&D projects and continued to make inquiries on these topics. In response, a revised edition reflecting the latest regulatory developments and practical issues has now been published.

In this revised edition, Attorney Hwang provides an in-depth discussion of the government’s right of implementation in relation to the ownership of rights to research outcomes from national R&D projects and offers a more detailed analysis of rights relating to research and development achievements at public research institutions.

The book also restructures its discussion around technology royalties, incorporates the key provisions of amendments that have modified the previous framework under the Framework Act on Science and Technology, and examines in detail the principal legal issues that may arise in the assessment and administration of technology royalties.
